TOURIST DRIVER MANILA (TDM) – TERMS & CONDITIONS
Thank you for choosing Tourist Driver Manila (TDM) for your travel, transfer, or tour services. Before confirming your booking, please read these Terms & Conditions carefully. They form an integral part of your agreement with Tourist Driver Manila (TDM), outlining the policies governing bookings, payments, cancellations, safety, conduct, and compliance.
1. APPLICABILITY & UPDATES
- a. Applicability
- T&C may be updated periodically to reflect changes in policies, services, or legal requirements; however, the version in effect at the time of your booking shall apply.
- By confirming a booking through any form of payment, you acknowledge that you understand and have the authority to accept the T&C on behalf of yourself and any participants included in your booking, and that all such participants have read, understood, and agreed to be bound by them.
2. BOOKING & PAYMENT
- a. Booking Confirmation
- A booking is considered confirmed only upon receipt of the required deposit or full payment through authorized payment channels.
- Bookings are processed on a first-come, first-served basis. If the requested service is unavailable, any payments received shall be refunded in full.

- The required deposit amount for each service is listed below and will also appear in the booking portal, service webpage, or confirmation email:
- Day Tour Package: ₱500 per participant.
- Multi-Day Tour Package: 50% of the total cost.
- Transfer Service: 10% of the total rate.
- Rental Service: 10% of the total rate.
- The required deposit time frame communicated through our official booking platforms or correspondence must be strictly observed to secure the client’s booking. Timely deposit ensures confirmation and protection of the reserved vehicle, driver, and any applicable third-party supplier arrangements. Failure to make the deposit within the specified period may result in forfeiture of priority or availability for the requested service.

- Failure to settle the balance within the stated conditions may result in service delays, booking cancellation, and forfeiture of the deposit.

- Any transfer fees, bank charges, or online payment surcharges shall be shouldered by the client and are not deductible from nor included in the total service cost.
- Payments made through unofficial or unverified channels will not be recognized by TDM, and the company shall not be held liable for any loss or dispute arising from such transactions.
- e. Price Adjustments
- TDM reserves the right to adjust rates in case of significant changes in fuel prices, government taxes, or other external factors—but only for services not yet confirmed or paid.

3. CANCELLATION, AMENDMENTS & REFUNDS
- a. Cancellations
- Transfer Service & Rental Service deposits are strictly non-refundable.
- Tour Package:
- If cancellation is made less than 30 days before the scheduled tour, the full hotel room payment will be forfeited, while any remaining balance shall be refunded.

- Requests for changes to booking details — including add-ons, extensions, time adjustments, detours, or any services not indicated in the booking confirmation — are subject to prior approval and may incur additional charges.

- Failure to appear at the scheduled date and time without prior notice shall be treated as a cancellation, and all payments made shall be forfeited.
- Any portion of the service not utilized due to the client’s decision, delay, or failure to participate shall be considered forfeited and non-refundable.

4. SERVICE GUIDELINES
- a. Description of Services
- Tourist Driver Manila (TDM) provides Tour Package, Transfer Service, and Rental Service, each of which includes a licensed professional driver and vehicle for your safety and convenience.
- Each service type has its own quotation and specific inclusions, which may be reviewed on their respective webpages or in the booking confirmation.
- Tour Packages are thoughtfully tailored to ensure comfort and convenience for both passengers and drivers while maximizing the enjoyment and satisfaction of each destination.
- Transfer Service offers safe and reliable point-to-point transportation between designated pick-up and drop-off locations. All published rates are calculated with fairness and transparency, and may vary depending on the agreed locations and time of travel.
- Rental Service includes not only the use of a private vehicle but also a licensed professional driver to ensure passenger safety and protect company property. Rates may vary depending on rental duration, travel distance, and out-of-town or overnight driver requirements.
- b. Exclusions
- Costs not expressly included shall be covered directly by the client or reimbursed to the driver, unless otherwise specified.

- c. Service Hours & Itineraries
- Tour Package — Itineraries are carefully structured with consideration of travel duration, distance, routes, and other relevant factors. Adjustments may be made at the discretion of TDM or the assigned driver to ensure safety, efficiency, and the best possible travel experience.
- Transfer Service — The agreed pick-up and drop-off locations and times must be strictly followed to avoid delays. Additional requests such as stopovers, side trips, or extended waiting times are not included in the base service and may incur additional charges unless otherwise stated at the time of booking.
- Rental Service — Assigned drivers and vehicles are exclusively allocated to the client for the booked duration and remain dedicated throughout the service period.
- Rental hours must be used continuously within the booked day. Split-hour or interrupted use within the same day is not permitted, and rates cannot be reduced for unused hours.
- For out-of-town or overnight rentals, service days must be used consecutively. Unused or “break” days are not allowed and will still be counted as part of the rental period.
5. PASSENGER CONDUCT & RESPONSIBILITY
- a. Health
- Passengers are expected to be in a fit condition to travel. Any existing medical condition, disability, or special requirement that may affect participation must be disclosed at the time of booking, including but not limited to:
- Pregnancy, particularly if the tour involves long travel hours, strenuous activities, or rides (e.g., boat, horseback, etc.).
- Mobility limitations or physical disabilities.
- Chronic illnesses or medical conditions that may require special assistance.
- TDM reserves the right to refuse service if a passenger’s condition poses a safety risk to themselves or others.
- TDM shall not be held liable for any incident, injury, or health-related complication arising from a passenger’s pre-existing medical condition or undisclosed health issue during the course of service.

- Passengers must comply with all applicable local laws, regulations, and customs of the areas visited.
- Possession of illegal substances, prohibited items, or engagement in unlawful activities shall result in immediate termination of service without refund, and may be reported to authorities.

- Respectful conduct towards drivers, fellow passengers, and third parties is required at all times. Disorderly, abusive, or unsafe behavior, including intoxication, may result in removal from service or cancellation of the program without refund.
- Smoking and drinking of alcoholic beverages are strictly prohibited inside the vehicle.
- e. Traffic Compliance
- Passengers must not request or pressure the driver to violate traffic laws or safety regulations, including but not limited to speeding, illegal parking, or unauthorized road access.
- Any such request shall be disregarded by the driver, and itineraries may be adjusted to ensure compliance with traffic laws.
- f. Personal Belongings
- Passengers are responsible for the security of their personal belongings at all times.
- TDM shall not be held liable for loss, theft, or damage to items left unattended or inside the vehicle.
- g. Vehicle Care & Damage
- Passengers are expected to treat the vehicle with care.
- Any significant cleaning required due to passenger negligence will incur a fee.
- In cases of intentional or malicious damage to the vehicle, the passenger shall bear full financial responsibility and may face criminal charges for malicious mischief under applicable law.
- h. Adherence to Itinerary and Schedule
- Passengers are expected to comply with the agreed itinerary, designated pick-up and drop-off points, and scheduled departure times.
- Any delay, failure to appear, or deviation from the confirmed itinerary without prior notice may result in shortened tour duration or forfeiture of unused services, without entitlement to a refund.

- Failure to adhere to the above responsibilities, or to any other provisions of these Terms & Conditions, grants TDM the right to refuse service, modify arrangements, or terminate the program without liability for refund or compensation.

6. THIRD-PARTY PROVIDERS

- Some services offered by TDM (e.g., accommodations, ferries, boats, meals, entrance tickets, guided tours, or other travel-related arrangements) may be provided by independent third-party providers.

- While TDM selects reputable partners, it has no direct control over their schedules, policies, or performance.

7. FORCE MAJEURE & SERVICE LIMITATIONS
- a. Acts of Nature
- TDM shall not be liable for delays, changes, or cancellations caused by natural disasters or weather-related events such as earthquakes, floods, storms, or other conditions beyond human control.
- TDM reserves the right, at its sole discretion, to cancel or suspend trips if such conditions are deemed dangerous to the safety of passengers or drivers.

- Service interruptions may arise from government restrictions or regulations, war, riots, civil unrest, acts of terrorism, epidemics, or pandemics.
- In such cases, TDM reserves the right to alter or cancel services without liability.

- If a force majeure event or other unforeseen circumstance occurs, TDM may cancel or amend services that jeopardize passenger safety or vehicle integrity. Affected bookings may be rescheduled or refunded, as applicable.

- Drivers are bound by legal and safety regulations, including restrictions on maximum working hours and required rest periods.
- Adjustments to itineraries may be necessary to ensure compliance and the safety of all passengers.

- Vehicles provided are intended for standard road use. They may not be operated on rough roads, flooded areas, or hazardous terrain.
- In the event of mechanical, operational, or regulatory issues, TDM will provide reasonable assistance, which may include arranging a replacement vehicle when possible.

- TDM reserves the right to alter, suspend, or cancel services if passenger conduct, health conditions, or external circumstances present a risk to safety, wellbeing, or vehicle integrity.

- If a tour or transport service is canceled, or services remain unutilized due to any of the circumstances described under Force Majeure & Service Limitations, third-party services included in the booking may only be rescheduled or refunded in accordance with their respective terms and conditions, and in some cases may not be refundable at all.
- TDM will, however, exert reasonable effort to assist the client in coordinating rescheduling or recovery of eligible refunds where possible.
8. INSURANCE & EMERGENCY RESPONSE
- a. Passenger Insurance
- We strongly recommend obtaining comprehensive travel insurance before your trip. Insurance coverage in the Philippines is generally limited, and TDM is not responsible for any costs related to accidents, illness, or loss during your stay.
- Any expenses arising from medical treatment, hospitalization, or evacuation are the sole responsibility of the client.

- TDM will make reasonable efforts to provide or arrange first aid and/or emergency care in the event of injury or illness occurring during the program. This may include arranging for emergency evacuation, medical assistance, or transportation to the nearest facility.
- However, you acknowledge and agree that TDM is not financially or legally responsible for any medical costs, outcomes, or consequences that occur beyond the company’s reasonable capability and control.
- c. Driver & Vehicle Safety
- All TDM vehicles are maintained in accordance with legal and safety standards.
- Drivers are trained to prioritize passenger safety, comply with traffic regulations, and respond appropriately in emergencies.
9. INDEMNIFICATION
- a. Indemnification Obligation
- By booking and participating in TDM services, you agree to indemnify, defend, and hold harmless Tourist Driver Manila (TDM), its owners, employees, drivers, affiliates, and representatives from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of:
- Your breach of these Terms & Conditions;
- Your negligence, misconduct, or violation of applicable laws during the program;
- Injury, loss, or damage caused by your failure to follow safety instructions or comply with service guidelines;
- Any claim made by third parties as a result of your actions during the course of service;
- Any cancellations, delays, or changes arising from force majeure events or other circumstances beyond TDM’s reasonable control.
